1. Who is responsible?
VivaCreo is the private AI creative application operated by REexcellent GmbH, Ottweilerstraße 15, 81737 München, Germany. For privacy questions, contact help@vivacreo.com. REexcellent GmbH is registered with Amtsgericht München under HRB 205869.
Android developer and maintenance partner: Semy WEB GbR. Semy WEB GbR also supports the publication and release management of VivaCreo in Google Play.
2. Information we process
When you create or use an account, we process your name, username, email address, password hash or Google sign-in identifier, verification and login events, session information, preferences and account status.
When you use Studio, we process prompts, uploaded images, video or audio, references, selected model and settings, operation status, errors and generated results. We process this information to provide the feature you requested and keep the creative context together.
When you contact support, we process your message, attachments and the account or order context needed to respond.
3. Why we use it
- to create, store and display the images, video and audio you request;
- to authenticate your account and protect it from misuse;
- to maintain reliability, troubleshoot errors and improve the application;
- to provide support, security and service messages;
- to process purchases, credits and refunds where applicable; and
- to comply with legal duties and establish, exercise or defend legal claims.
The legal bases are contract performance, legal obligations and legitimate interests in a secure and reliable service, as applicable. Optional Google sign-in is used only when you choose it.
4. AI providers and service partners
The selected AI inference provider receives the prompt and the files needed for the requested generation. VivaCreo does not use your files to train its own models. Infrastructure, protected media storage, transactional email, payments and authentication may be provided by specialist partners under their applicable terms and safeguards.
Google user data is used only to create or link your VivaCreo account, authenticate sign-ins and display basic account information. It is not sold, used for advertising or sent to AI providers as part of Google sign-in.
5. Private workspace
Your chats, prompts, uploads and generated results are private to your account. VivaCreo does not provide public profiles, public galleries or public share links. If you download or publish a result outside the application, you are responsible for that publication.
6. Storage and retention
Account data is kept while your account is active. Prompts, uploads and results are kept until you delete them or request account deletion, subject to active operations, backups, security investigations and legal retention duties. Payment and accounting records are retained for the periods required by law. Sessions expire according to their security settings.
You can delete eligible uploads and creations in the application. You can request account deletion from the account deletion page.
7. Device permissions and local storage
The Android application may request access to files or media when you choose to upload a reference or save a result. It may store authentication state, cached chat metadata and media locally to improve offline reopening and reduce repeated downloads. Logging out does not automatically erase the local cache; deleting the account or using the in-app privacy controls begins the relevant deletion process.
8. Security
We use owner-scoped records, access controls, signed protected downloads, rate limits and operational safeguards. No online service can guarantee absolute security. Keep your password private and contact us promptly if you suspect unauthorized access.
9. Your rights
Subject to applicable law, you may request access, correction, deletion, restriction, portability or object to processing based on legitimate interests. You may withdraw consent where processing is based on consent. Contact help@vivacreo.com; we may ask for proportionate information to verify your identity. You may also complain to the Bavarian State Office for Data Protection Supervision (BayLDA), Promenade 18, 91522 Ansbach, Germany.
10. Children and changes
VivaCreo is intended for people aged 18 or older and is not directed to children. We will update the date above when this policy changes and provide additional notice where a change materially affects existing processing.
